Our job at Martin-Kaye is to try to make the process of separating from your partner as pain free as possible. We will always at our first meeting discuss with you whether it is possible to save the relationship, and can provide you with further information about counseling and therapeutic agencies who may be able to help you get things back on track.
If the relationship cannot be saved, then we can give you advice and information as to the way forward. There are a number of options available to you in addition to divorce, and we can help you decide which would be the most appropriate route to explore.
If you do decide that divorce is inevitable, then there is only one ground for Divorce which is the "irretrievable breakdown of the marriage" although this must be evidenced by one of five facts - adultery, unreasonable behaviour, desertion, two years separation with the consent of the other party, and five years separation, which does not require the other party's consent.
We can advise you on the most appropriate fact to use in your particular case, and can prepare the necessary paperwork and advise you at each stage throughout the
court process.
In addition to divorce, we can advise you on alternative options such as judicial separation, which is a separation formalised by an application to the court, or alternatively an informal separation with both of you living separately, but dealing with the financial matters by way of a "deed of separation" until you feel able to make long term decisions.
