We can then assess your likely prospects of success and decide whether we can assist you with a claim. We will also discuss the various methods of funding your personal injury claim to find the best option for you. You may, for example, already have some legal expenses insurance that would enable you to fund your claim and we will look into this for you. The majority of our cases are run on no win, no fee agreements.
If we decide that a no win, no fee agreement is the best way to fund your claim, there is no cost to you if the claim is unsuccessful, provided that you have entered into an insurance policy which we will take out on your behalf and provided that you comply with your obligations. If your claim is successful, the majority of your basic legal costs and disbursements will be paid for by the third party. Costs which are not recoverable from the third party will be deducted from your general damages and past losses; however, the deduction will not exceed 25 percent of your general damages and past losses. The cost of the insurance will be included in this deduction.
There are also alternative ways of funding a claim. You may have trade union membership or an existing insurance policy that will pay your legal expenses. We will discuss all available options with you.
